Shenzhen Jiutian Ruiling Culture Communication Co., Ltd., with registered address at Room F621, Building F, 331 Creative Park, Yintian Industrial Zone, Yantian Community, Xixiang Subdistrict, Bao'an District, Shenzhen, Guangdong, China (hereinafter referred to as "Jiutian" or "we"), hereby reminds users (hereinafter referred to as "you" or "user") to carefully read all the terms and conditions of this Terms of Service (hereinafter referred to as this "Agreement"), including but not limited to those terms that exempt or limit Jiutian's liability, restrict users' rights, and stipulate dispute resolution methods and judicial jurisdiction. Please read this Agreement carefully (minors should read it accompanied by their legal guardians) and choose whether to accept or not accept this Agreement. Unless you agree to and accept all the terms of this Agreement, you are not entitled to receive, download, install, start, upgrade, log in, display, run, or screenshot Jiutian Games, nor are you entitled to use any function or part of the game software or otherwise use the game software. Your act of receiving, downloading, installing, starting, upgrading, logging in, displaying, running, screenshotting Jiutian Games, or using any function or part of the game software, or otherwise using the game software, shall be deemed as your agreement to and acceptance of this Agreement and your willingness to be bound by all the terms of this Agreement.
The conclusion, execution, and interpretation of the terms of this Agreement, as well as the resolution of disputes, shall be governed by the laws and administrative regulations of the People's Republic of China. In case of any dispute between the parties regarding the content and execution of the terms of this Agreement, the parties shall endeavor to resolve the dispute through friendly negotiation; if negotiation fails, both parties have the right to bring a lawsuit before the people's court with jurisdiction in Nanshan District, Shenzhen, Guangdong Province, where Jiutian is located.
This Agreement consists of two major parts. The first part is the Required Clauses of the Standard Form Contract for Online Game Services formulated by the Ministry of Culture in accordance with the Interim Measures for the Administration of Online Games (Ministry of Culture Decree No. 49). The second part is the online game service agreement terms formulated by Jiutian in accordance with national laws and regulations such as the Copyright Law of the People's Republic of China, the Contract Law of the People's Republic of China, the Implementing Measures for Administrative Penalties for Copyright Infringement, and the Interim Measures for the Administration of Online Games.
1.1 You undertake to register as a user with your true identity and warrant that the personal identification information provided is true, complete, and valid, and shall bear corresponding legal liabilities for the information provided in accordance with legal provisions and the required clauses.
1.2 After you have registered as a user with your true identity and need to modify the personal identification information provided, we shall provide such service promptly and effectively.
2.1 In accordance with the required clauses, we have the right to verify whether the identity information provided by you upon registration is true and valid, and shall actively take reasonable measures including technical and managerial means to ensure the security and validity of your account; you have the obligation to properly keep your account and password, and to use your account and password correctly and safely. Any party that fails to fulfill the above obligations, resulting in loss of account password, account theft, or other circumstances that cause damage to your civil rights or those of others, shall bear the legal liability arising therefrom.
2.2 You shall enjoy rights and bear liabilities in accordance with the law for the acts conducted under your account after logging in.
2.3 If you discover that your account or password is being used illegally by others or there are abnormal usage situations, you shall promptly notify us according to the handling methods published by us, and has the right to notify us to take measures to suspend the login and use of the account.
2.4 When we take measures to suspend the login and use of your account upon your notification, we shall require you to provide and verify personal valid identification information consistent with your registered identity information.
2.4.1 If we verify that the personal valid identification information provided by you is consistent with the registered identity information, we shall promptly take measures to suspend the login and use of your account.
2.4.2 If we violate the provisions of Clause 2.4.1 and fail to promptly take measures to suspend the login and use of your account, thereby causing losses to you, we shall bear corresponding legal liability.
2.4.3 If you fail to provide your personal valid identification document or the personal valid identification document provided is inconsistent with the registered identity information, we have the right to refuse your above request.
2.5 When you provide personal valid identification information consistent with your registered identity information to protect your legitimate rights and interests, we shall provide necessary assistance and support such as account registrant certification and original registration information, and shall provide relevant evidentiary information to relevant administrative authorities and judicial organs as needed.
3.1 If you engage in conduct such as publishing illegal information, seriously violating social morals, or other conduct prohibited by laws, we shall immediately terminate the provision of services to you.
3.2 If you engage in improper conduct while receiving services from us, we have the right to terminate the provision of services to you. The specific circumstances of such improper conduct shall be clearly stipulated in this Agreement or constitute prohibited conduct for which service termination has been explicitly notified by us in advance; otherwise, we shall not terminate the provision of services to you.
3.3 If you provide false registration identity information or engage in conduct that violates this Agreement, we have the right to suspend the provision of all or part of the services to you; we shall notify you of the suspension measures and inform you of the suspension period, which shall be reasonable, and we shall promptly resume services to you upon the expiration of the suspension period.
3.4 If we suspend or terminate the provision of part or all of the services to you in accordance with this clause, we shall bear the burden of proof.
4.1 When we require you to provide information related to your personal identity, we shall beforehand disclose our privacy protection policy and personal information use policy to you in a clear and conspicuous manner, and take necessary measures to protect the security of your personal information.
4.2 Without your permission, we shall not provide, disclose, or share with any third party the personal identification information in your registration data, including name, personal valid identification document number, contact information, home address, etc., except in the following circumstances:
The following proprietary terms used in this Agreement shall be interpreted as follows:
5.1 "Jiutian Game Service Agreement" or this "Agreement" refers to the software license and service agreement currently entered into between you and us, concerning the rights you enjoy and obligations you bear in the process of using and enjoying the Jiutian game products and services provided by us to you.
5.2 "User" or "you," also known as "player," refers to the natural person who uses and enjoys the Jiutian game products and services.
5.3 "Software Element Works" refer to the collective term for individual works that can be used separately after being separated from the game software, and are inseparable components of the game software, including but not limited to: (1) electronic documents, text, databases, pictures, charts, graphic decorations, illustrations, photos, programs, music, dance, colors, layout frameworks, interface designs; (2) computer programs, art pictures, textual content, music, songs, and dance content that can independently constitute works under the meaning of copyright law.
5.4 "Game Data" refers to the collective term for various numbers, letters, symbols, and analog quantities that are instantly recorded and stored by the server software during your or other users' use and enjoyment of Jiutian game products and services, including but not limited to game logs and security logs.
5.5 "Game Derivatives" refer to the collective term for items produced by directly using, modifying, adapting, or otherwise utilizing a certain game software, or the software element works, LOGO, name, and/or trademark of such game software.
5.6 "Intellectual Property Rights" refer to any and all of the following intellectual property rights and all inherent, derivative, and/or related rights therein: (1) specifications, designs, inventions, discoveries, and patents applied for and pending therefrom; (2) copyrights and copyright-related rights of software, software element works, work-type derivatives, game process derivatives, game editing derivatives, and other works; (3) naming rights, trademark rights, and other rights arising from company or product identifiers.
5.7 "Real-Name Registration" refers to the requirement that we require you to register your personal information with a valid identity document under your real name, thereby establishing a one-to-one matching relationship between your personal information and the game account you use in Jiutian Games.
6.1 The contractual purpose of this Agreement is to provide a contractual basis for us to license you to use and enjoy Jiutian game products and services, and to stipulate the rights you enjoy and obligations you bear in the process of using and enjoying Jiutian game products and services under this Agreement.
6.2 Some functions of Jiutian Games are not realized through or solely through Jiutian Games, but require the simultaneous use of Internet services realized by other software developed or operated by us and/or our partners. Therefore, your use of the above-mentioned functions is not only bound by this Agreement, but also by the corresponding other software license agreements or service agreements.
6.3 In the process of using and enjoying Jiutian game products and services, you may use software or intellectual property licensed to us by third parties. Such use must be within the scope of third-party authorization and in compliance with the contractual purpose of this Agreement.
7.1 The ownership and all intellectual property rights including copyright of this Agreement and any of the following works or materials are enjoyed by us, and are protected by the Copyright Law of the People's Republic of China, the Regulations on the Protection of Computer Software, the Regulations on the Protection of the Right of Communication through Information Networks, the Trademark Law of the People's Republic of China, relevant international treaties, and other laws and regulations: (1) the game software of Jiutian Games; (2) the software element works of Jiutian Games; (3) the game data of Jiutian Games; (4) the game process derivatives and game editing derivatives of Jiutian Games; (5) works or materials submitted by you to us upon our invitation in the process of providing services related to Jiutian Games.
7.2 The copyright of personal works provided by you to us upon our invitation for Jiutian Games shall be solely owned by you, and we shall enjoy a perpetual, worldwide, irrevocable, and completely free right of use. Once such works are provided by you to us, you are deemed to have granted us such right of use, and we may also transfer or sublicense such right of use to our affiliated companies or partners.
7.3 What we license to you under this Agreement is a non-exclusive right to use Jiutian Games. Such non-exclusive right of use is temporary, revocable, and within the scope stipulated in this Agreement.
7.4 This Agreement does not and will not license to you the right of distribution, right of communication through information networks, and/or right of rental, or any other copyright rights not expressly granted herein of Jiutian Games; these rights are solely enjoyed by us. What we license to you through this Agreement is only the right to use and enjoy Jiutian game products and services online through the Internet.
8.1 You are responsible for the safekeeping of your account, password, real-name registration, and personal information for anti-addiction registration, and shall bear full responsibility for all activities under your account and password. You warrant that you will immediately notify us if your game account or password is used without authorization or any other security issue occurs.
8.2 You fully understand that in order to improve the security performance of Jiutian Games and prevent your password, real-name registration, and personal information for anti-addiction registration from being stolen by others, we may at any time incorporate computer virus detection technology, operating system repair technology, computer encryption technology, and other computer hardware or software that help improve the security performance of Jiutian game software into Jiutian Games. Even so, this does not exempt or mitigate your obligation to properly keep your account, password, and other related information.
8.3 We have always complied with national laws and policies on the protection of the physical and mental health of adolescents, and have developed and built into Jiutian Games an anti-addiction system in accordance with the national Development Standards for Online Game Anti-Addiction Systems. You fully understand that we may apply your real-name registration information to the anti-addiction system, that is, we may determine whether you are over 18 years old based on your real-name registration information, and thus decide whether to impose anti-addiction restrictions on your corresponding game account.
9.1 Like other online Internet software, for Jiutian Games, if you want to download, install, start, log in, display, and/or run them, you must at least have a computer of your own, install the client software of Jiutian Games on that computer, and ensure that it can conduct real-time information interaction with the server software of Jiutian Games through the Internet.
9.2 When using the paid functions of Jiutian Games, you shall pay the corresponding fees in accordance with our requirements. Moreover, such rights belong to our operational autonomy, and we reserve the right to change our business model at any time, that is, reserve the right to change the fee rate standards, fee-charging software functions, fee-charging objects, and fee-charging time, etc. At the same time, we also reserve the right to upgrade, revise, add, delete, modify, change the functions, or change the game rules of Jiutian Games. If you do not accept such changes, you shall immediately stop using Jiutian Games; your continued use of Jiutian Games shall be deemed as your acceptance of the changed business model.
9.3 Based on this Agreement, you may: (1) receive, download, install, start, upgrade, log in, display, run, and/or screenshot Jiutian Games; (2) create Jiutian game characters, set screen names, consult game rules, user personal data, game match results, open game rooms, set game parameters, use chat functions, purchase and gift game currency, game chips, game props; (3) use other functions of Jiutian Games beyond the above-listed functions.
9.4 In addition to using Jiutian Games in accordance with the provisions of this Agreement, you shall not engage in any conduct that infringes upon the intellectual property rights of Jiutian Games or its software element works, or that undermines the operational environment and fairness of the online game, or that otherwise harms the legitimate rights and interests of us or other users. We will never permit you to engage in such conduct, and also have the right to take technical measures to prevent you from engaging in such conduct, including but not limited to: (1) deleting or modifying copyright information on Jiutian Games, or forging ICP/IP addresses or data packet names; (2) compiling, decompiling, reverse engineering, or otherwise cracking Jiutian Games; (3) engaging in any conduct that undermines the fairness of Jiutian Games or otherwise affects the normal order of the game, such as actively using cheats or passively point-farming, partnering in cheating, using game cheats or other cheating software, exploiting BUGs to obtain improper illegal benefits, or making game cheats, cheating software, or BUGs public; (4) using technologies such as DNS hijacking to illegally intrude upon, damage the server software system of Jiutian Games, or modify, add, delete, steal, intercept, replace data in the client and/or server software system of Jiutian Games; (5) engaging in any commercial conduct such as publishing advertisements or selling goods, or engaging in any illegal conduct that harms our interests; (6) publishing, forwarding, or disseminating illegal remarks containing abusive, cursing, defamatory, attacking, slanderous, harassing content, or containing feudal superstition, obscenity, pornography, indecency, terror, violence, homicide, gambling, reactionary content, inciting ethnic hatred, undermining national unity, or subverting state power; (7) engaging in malicious screen-spamming, malicious time-wasting, or other conduct that maliciously disrupts the public order of the game; (8) using Jiutian Games to deliberately spread malware or computer viruses, or using Jiutian Games to publish, forward, or disseminate content that infringes upon the intellectual property rights, portrait rights, name rights, reputation rights, privacy, or other legitimate rights and interests of third parties.
9.5 You hereby fully agree and accept that when user data is clearly abnormal, we have the right to determine whether you have engaged in cheating or other improper conduct by checking your IP address or using relevant technical means, and to impose penalty measures.
9.6 Without our permission, you shall not engage in any of the following conduct; if you intend to engage in any of the following conduct, please contact us to obtain our consent and, upon our request, enter into an electronic or paper written contract with us: (1) scanning, probing, or testing Jiutian Games to detect, discover, or find possible BUGs or weaknesses; (2) modifying, copying, distributing, leasing, publishing, translating, compiling, adapting, and/or reprinting Jiutian Games, or its software element works, game process derivatives, game editing derivatives; (3) establishing mirror sites for Jiutian Games, or its software element works, game process derivatives, game editing derivatives, or conducting webpage snapshots, or using Jiutian Games to set up servers to provide others with identical or similar Internet services; (4) embedding various plugin programs or other third-party programs in Jiutian Games; (5) separating software element works from Jiutian Games for independent use; (6) producing, manufacturing, wholesaling, selling, publishing, and/or distributing game adaptation derivatives; (7) using the name, trademark, and/or software element works of Jiutian Games; (8) engaging in other conduct related to Jiutian Games that requires our consent.
9.7 If the account you are currently using was not applied for by you or obtained through other channels provided by us, but you have come to know the current password of that account, you shall notify us or the applicant of that account within the earliest possible time. Moreover, you shall not: (1) use that account and password to log in to Jiutian Games or enjoy other Internet services provided by us; (2) modify the password, application materials, personal data, or email under that account; (3) use that account to buy, sell, transfer, gift, or accept gifts of virtual currency or items; (4) transfer, sell, or gift that account or the materials thereunder to unrelated third parties; (5) make public through the Internet or other means that account and the materials thereunder; (6) use or dispose of that account, password, and materials under that account in other ways.
9.8 We may provide users with download services for the Jiutian game client software on the Jiutian Games official website or third-party cooperation platforms.
9.9 We may provide you with ways to obtain virtual items such as Jiutian coins, game currency, and game props through channels such as the "Game Mall" on the Jiutian Games official website or other means. We prohibit obtaining the above game items from third parties other than us and our partners through accepting gifts or other means.
9.10 We may provide you with customer services such as game rule explanations, game BUG or cheat reporting, game item retrieval, game item locking or unlocking, account appeal, temporary account suspension, modification and/or verification of real-name registration information for Jiutian game accounts, etc. You shall: (1) learn about the content, requirements, and fees of these customer services through the channels provided by us; (2) not engage in prohibited conduct while receiving services from us; (3) agree to and accept the special agreements or terms for such customer services; (4) provide truthful personal information including valid identity information and game status in accordance with our requirements.
9.11 In the process of providing you with customer services, we may require you to provide a written explanation of your needs, relevant circumstances, and evidence by filling out complaint forms online, sending emails, screenshots, video recordings, mailing paper letters, providing your valid identification documents, or other means. You shall provide such information truthfully, to the fullest extent, and without reservation.
9.12 In the process of enjoying customer services, we may need to perform remote assistance on the computer you are using through the Internet. If you request us to provide such customer services, you need to grant us the permission to perform remote assistance and bear the losses that may be caused to you thereby.
9.13 We will make our best efforts to improve the quality of customer services and to meet your service requirements. Even so, we still reserve the right to charge you corresponding service fees or other remuneration, and does not guarantee that the services provided will necessarily meet your requirements.
9.14 Jiutian Games may introduce the game rules to you in prominent positions of the online game. You fully agree and undertake to play the game in accordance with such game rules; if you do not agree, please do not use Jiutian Games.
9.15 If, in the process of using and enjoying Jiutian game products and services, you discover that Jiutian Games cannot fully or partially realize the corresponding game rules as described by us, please immediately stop using the part of the game content or game area that does not conform to the game rules, and notify us at the earliest possible time. We will repair it as soon as possible.
9.16 If we have not yet registered a trademark for one or more of our Jiutian Games, you shall not register a trademark therefor without authorization. Otherwise, you shall cooperate with us in applying to the Trademark Office for cancellation of the registered trademark, or transfer the registered trademark you have obtained to us gratuitously, completely, and irrevocably.
9.17 You fully understand that we may update Jiutian Games from time to time by releasing software upgrade packages or software patches, online upgrades, etc. During the update process, we may collect through the Internet the version information, data, and other relevant information of the Jiutian game client software on your personal computer, and automatically replace, modify, delete, and/or supplement them. Such conduct is a necessary operation or step for software updates.
9.18 You fully understand that for Jiutian Games, some of the updates may be software version updates, and if you do not perform such updates, you will not be able to log in to Jiutian Games. Moreover, such updates will cause the original software version on the computer you are using to be completely replaced by the new software version.
9.19 You fully understand that game data will occupy the server space of Jiutian Games. Retaining for a long period all game data generated during your use and enjoyment of Jiutian game products and services will occupy a large amount of server space, affect the game speed of you and other Jiutian game users, and increase our operating costs. Therefore, we will periodically transfer or permanently delete some past game data stored on the server.
9.20 In order to test the functions of Jiutian Games, user carrying capacity, find possible BUGs, or conduct other quality testing activities, we may release some software test versions for users to experience, test, and provide feedback before or after the official release of Jiutian Games, and may invite you to participate in the experience and testing.
9.21 You fully understand that the software test versions are not open to all users. Please do not disclose the launch codes, network link addresses for client software downloads that you have come to know to others, nor provide the client software to others. Moreover, you shall truthfully, without reservation, accurately, and completely inform us of the BUGs and other issues discovered during the experience and testing process.
9.22 You fully understand that the software test versions are only temporary versions used by us for some users to experience and test. We will delete the server software of such versions from the server or replace them with new software versions when we deem that they have fulfilled their mission. Upon deletion or replacement: (1) you will no longer be able to continue logging in to or using that version; (2) the game data generated during your experience and testing process will be permanently deleted; (3) the game currency, game props, points, levels, or honors obtained during your experience and testing process will be permanently deleted.
9.23 You fully understand that in the process of using and enjoying Jiutian game products and services, we may use cookies to collect information about your use of Jiutian Games.
9.24 You undertake and warrant that you have full copyright in the works you provide to us through the methods described in this Agreement, or although you do not have copyright, you have the right to license them to us for use in Jiutian Games.
9.25 We may, before using the works you provide, require you to issue a written authorization certificate and your identity certificate. If we need to use your portrait, name, or other legitimate rights and interests at the same time as using the works you provide, you agree to authorize us to use your portrait, name, and/or other legitimate rights and interests together.
10.1 If you violate the user code of conduct stipulated in Article 9 of this Agreement, we have the right to take one or more of the measures described in Article 10.2 of this Agreement. If your conduct causes economic losses to us or damages our commercial reputation or corporate image, we may require you to compensate and make a public apology; if your conduct constitutes a violation of laws and regulations, we will refer the matter to relevant administrative authorities for administrative penalties; if a crime is constituted, we will report to the relevant judicial authorities and pursue your criminal liability.
10.2 We have the right to take one or more of the following measures based on your violation: (1) temporary muting; (2) temporary or permanent account suspension; (3) deleting advertisements, false information, and/or illegal remarks; (4) deleting stolen goods; (5) deducting or resetting game currency, points, levels, and/or honors; (6) refusing to process account appeals; (7) other measures.
10.3 For the conduct described in Article 10.1 of this Agreement committed by you, we may continuously, intermittently, or alternately take one or more of the measures described in Article 10.2, and may permanently or temporarily suspend all or part of your network service usage rights depending on the severity of the circumstances. Any losses of electronic records such as virtual currency, points, and virtual items in the account caused thereby shall be borne by you.
10.4 We may publish the BUGs existing in the game through the Jiutian login window, its official website, or other channels. Even so, this does not exempt the obligation you bear under Clause (3) of Article 9.4 of this Agreement before our publication.
10.5 If you request us to provide customer services but fail to provide the corresponding materials and evidence in accordance with Article 9.11, we have the right to refuse to provide the corresponding customer services.
11.1 If there is a dispute between users regarding the ownership of the right to use a game account or game data, etc., they may request our customer service personnel to handle the matter through the contact methods provided by us.
11.2 Users undertake to comply with our requirements and procedures for handling such matters, and to provide corresponding materials to prove their claims. If a user cannot provide sufficient materials to prove the validity of their claim, and thus suffers damage, the user shall bear full responsibility independently.
11.3 Users agree to use the data recorded on our servers or systems as the criterion for handling disputes between users or between users and us.
11.4 Users shall bear all expenses such as communication fees, postage, and transportation fees incurred in handling such disputes.
11.5 If a user has a dispute with the dispute resolution made by us, the user may, within 10 days from the date of the penalty imposed by us, request our customer service personnel to handle the matter, state the reasons for their objection, and provide relevant materials as required by us. However, this shall not render the penalty measures invalid, nor shall it affect the execution of such penalty measures during the objection period. If the user fails to raise an objection to the penalty measures within 10 days, or although an objection is raised but sufficient supporting materials cannot be provided within 10 days, the user shall be deemed to have no objection, and we will no longer accept any related feedback.
12.1 We are not obligated to notify users before imposing penalty measures on violating users.
12.2 We shall use announcements published on our website, forums, game bulletin boards, and game system messages as the primary method of notification, which shall be deemed served as of the date of publication.
12.3 In individual cases, we may notify through login prompts, email, regular mail, or telephone, but we are not obligated to notify individually through such means.
12.4 Users undertake to pay careful attention to our notifications. We shall not bear any responsibility for damages caused by users' failure to timely see notifications due to their own reasons.
13.1 If you do not have the conditions described in Article 9.1 of this Agreement, you will not be able to use Jiutian Games or some functions of Jiutian Games. We shall not bear any responsibility to you for this.
13.2 Like other online Internet software, Jiutian Games may also be troubled by various adverse information, network security, and network failure issues, including but not limited to: (1) other users may publish fraudulent or false information, or publish illegal remarks containing abusive, cursing, defamatory, attacking, slanderous, harassing content; (2) other users may publish materials that infringe upon your or other third parties' intellectual property rights, portrait rights, name rights, reputation rights, privacy, and/or other legitimate rights and interests; (3) facing problems and threats such as hacker attacks, computer virus troubles, system crashes, network disconnections, slow network speeds, program vulnerabilities, etc.
13.3 You fully understand that the various adverse information, network security, and network failure problems described in Article 13.2 above are not problems caused by us or Jiutian Games. Any mental damage or other losses caused thereby shall be borne by you alone, and we and/or Jiutian Games shall not bear any responsibility to you.
13.4 You fully understand that obtaining Jiutian coins, game currency, game props, and other game items from unauthorized third parties may involve various risks. You shall not obtain the above game items from third parties. If you insist on obtaining the above game items from third parties, you shall bear the corresponding risks yourself, and we do not guarantee that such game items can be used normally in Jiutian Games, nor does it guarantee that such items will not be reclaimed.
13.5 You fully understand that the game rules introduced to you by us may be incomplete and limited. We do not guarantee that the introduction of Jiutian game rules is complete, sufficient, and without any omissions or errors, nor does it guarantee that Jiutian Games can fully, sufficiently, and without any omissions or errors realize these game rules.
13.6 You fully understand that in order to effectively curb users' use of BUGs or cheats in Jiutian Games, we may take maintenance downtime or rollback measures. During maintenance downtime, you may not be able to log in to Jiutian. Rollback may cause the game currency, game props, and other game items, as well as levels, points, honors, etc., obtained by you through normal game play during this period to be permanently lost, or cause other losses to you. You fully understand and are willing to bear this yourself, and we will not provide any compensation.
13.7 You fully understand that we may give you certain services provided by cooperative units or physical goods as prizes. However, we do not make any express or implied warranty as to the quality of such services and/or goods. If there are quality issues with such services and/or physical goods, please contact the relevant cooperative unit directly and resolve the related disputes or controversies with them yourself.
13.8 You fully understand that Jiutian Games may be wholly or partially interrupted, temporarily unavailable, or delayed due to failures, malfunctions, or human operational errors in the Internet system hardware and software of ourselves or our cooperative units, or may be tampered with or forged by others intruding upon the Jiutian game system. You shall not demand any compensation or damages from us.
13.9 You agree that your use and enjoyment of Jiutian game products and services is out of your personal willingness, and you are willing to bear any risks and any direct, indirect, or consequential damages caused thereby, and we shall not bear any responsibility. If it is impossible to completely exclude liability for damages in accordance with the law, our liability for compensation shall also be limited to the amount you have paid to us.
13.10 We reserve the right to suspend the performance of this Agreement and terminate this Agreement at any time, without prior notice, without any reason, and unilaterally. Such suspension or termination may be due to our dissolution, deregistration, merger, or division, or may be due to our transfer of the copyright or operating rights of Jiutian Games to a third party, or may be due to national laws, regulations, policies, and orders of state organs, or other force majeure events.
13.11 If this Agreement is: (1) suspended, then all users including you will temporarily be unable to log in to Jiutian with their game accounts until the expiration of the suspension period; (2) terminated, then all users including you will never be able to log in to Jiutian with their game accounts, and we will handle related matters by announcement or other means.
14.1 You fully understand that protecting user information is our consistent policy. For the personal information of you and other Jiutian game users, we will protect it in accordance with the Interim Measures for the Administration of Online Games, this Agreement, and our privacy policy. We will never disclose it to unrelated third parties, except for disclosure to third parties due to the following reasons: (1) disclosure required by national laws and regulations; (2) disclosure required by national judicial authorities and legally authorized government agencies based on statutory procedures; (3) disclosure to protect our legitimate rights and interests, those of cooperative units, or yours; (4) disclosure in emergency situations to protect the personal safety of other users and third parties; (5) disclosure with your consent or upon your request.
14.2 You fully understand that like other Internet enterprises and Internet software products, the personal information, data, works, or other materials that you generate or actively provide to us may be stored or destroyed by us. We may also organize, statistically analyze, and analyze them, ultimately forming and obtaining statistical data that only reveals and reflects the usage of Jiutian game products without displaying your personal information, for us to understand the usage of Jiutian Games, continuously improve the functions of Jiutian Games, and enhance the quality of Jiutian game products.
15.1 We reserve the right to revise this Agreement at any time, without prior notice, without any reason, and unilaterally. Once this Agreement is revised, we will completely replace the previous version of the agreement with the revised version and publish it to all users through the original means. You shall promptly pay attention to and understand the revisions to this Agreement. If you do not agree to the revised version of the agreement, please immediately stop using and enjoying Jiutian game products and services; otherwise, you shall be deemed to agree to and fully accept the revised version of the agreement.
15.2 The clauses of this Agreement are severable. If any clause is partially or wholly invalid, it shall not affect the legal validity of the other parts of that clause or the other clauses of this Agreement.
15.3 The headings of the clauses of this Agreement are only for the convenience of users to read and serve as prompts and highlights, and have no guiding effect on the interpretation and application of this Agreement.
15.4 This Agreement is concluded in Nanshan District, Shenzhen City, Guangdong Province, and is governed by the laws and regulations of the People's Republic of China. We reserve the final right of interpretation.
